Supreme Court declares Executive Order 10 unlawful, unconstitutional 

…..dismisses Governors suit seeking N66billion refund

Nigeria’s Supreme Court on Friday declared as unlawful and unconstitutional, Executive Order 10 ( EO10) enacted in May 2020, empowering the Federal Government to deduct funds for the state Legislature and the judiciary from the federation allocations to the states.

The decision made by six out of a seven- member panel agreed that the President exceeded his constitutional powers in issuing the executive order 10 and therefore, proceeded to set it aside.

The Apex court also dismissed the N66 billion suit against the Federal Government.by governors

The 36 State governors had filed a suit on September 17,2020, challenging the constitutionality of the executive order 10.

The governors through their Attorney Generals said with the signing of the executive order, the federal government had pushed the responsibility of funding capital projects and recurrent expenditures of state high courts,sharia court of appeal and customary court of appeal to the states.

They also applied for an order compelling the Federal Government to pay them N66 billion so far expended on capital projects for the three court’s .
