Gabriel Suswam, the Senator who represented Benue East in the 9 th National Assembly has been declared winner of the February 25,2023 Senatorial Election by the State Election Petition Tribunal in Makurdi.
Delivering the judgement which held for over three hours, the Tribunal sacked the All Progressives Congress’ (APC) Emmanuel Udende from the National Assembly.
Suswam, a member of the Peoples Democratic Party PDP and former governor of the state had failed in his bid to return to the Senate following the declaration of the APC candidate as winner by the Independent National Electoral Commission INEC .
Consequently, he took the matter to court and, the tribunal having expressed satisfaction with the arguments of the petitioner declared him the winner of the election .
However there is a window of appeal by the sacked lawmaker as the court of appeal is the final arbiter of National Assembly elections..
