
Justice lnyang Ekwo of the Federal High Court on Monday refused to grant the prayers seeking to immediately release DCP Abba from the custody of NDLEA.
The Judge ordered Abba Kyari’s lawyer to put the respondent, NDLEA on notice and a date fixed to hear the motion.
Counsel to Abba Kyari, Cynthia Obianuju Ikena had told the court that she” filed the motion to admit the applicant to a bail on health grounds pending the determination of the substantive matter.”
According to her, Kyari’s condition is critical as he suffers from diabetes.
Earlier,Abba Kyari filed a suit at the Abuja High Court over his continued detention..
In the suit marked FHC/ ABJ/182/22, Abba Kyari is praying the court to immediately release him from the custody of the National Drug Law Enforcement Agency ( NDLEA).
Abba Kyari has been in detention for about a week over alleged crimes bordering on illicit drug trafficking.
He was accused by the NDLEA of being a member of a drug cartel that operates along Brazil- Ethiopia- Nigeria routes.
A few days after his arrest, he was linked to a multi billion naira tramadol seizure with the whereabouts of the seized products unknown.
